Continued from page 7 on rides in the past i have remarked about the changes and chances of mountain weather. this day was no exception with a returning southerly flow of air, forced up over the mountains, creating a cool cloud cover in dillard. also there was snow on the ground. cool and moist a bad combination for those trying to stay warm. while in augusta i had my regular gloves on. up in the mountains i found myself putting my gerbing gloves back on and turning the thermostat to a higher setting. in front of the dillard house sign i threw slushy snowball at brett. we had been lucky so far in our adventures. i now had one last curve for the committee. one of the two problems i have with north georgia is dalton. i don t like driving through there, and bill s route goes that way. with all those carpet mills, the congestion is too much. i plotted a northern route out of georgia into north carolina and tennessee, which was actually shorter. just west of hiawassee i missed my right hand turn to go up us64. it was my fault. brett didn t have the route for his gps, and he was leading. so i took the lead and navigated on the fly again out of blairsville on us19 up to us64, which was a longer road than i had wanted to take. we got stuck behind slow traffic because i just cannot pass easily on unfamiliar two lane roads in the hills. i don t have the power. when we got to us64 i let brett have the lead again. this is a really nice road that has four lane sections and then runs two lanes down into the oconee river gorge by the 1996 olympic white water venue. it was a beautiful ride. and after a day and a half of being tied to me, i let the fjr have his head. he passed and was gone. i rode the next 15 miles solo until i found brett at a roadside gas stop just before cleveland, tn grinning ear-to-ear. from there it was a speed run down i-75 to i24 to i-59 into the state of dade near trenton. we found the last corner, got our pictures in front of the community center fire station and then went down off the hill to get a fuel receipt from the gas station next to the interstate to end the ride. i m sure the committee was waiting for us in dalton. i m sooo glad i bypassed it. what i didn t know was how hard they would come storming after us after the completion of the ride. from trenton i took brett up over the lookout mountain ridge and down the ridgeline by cloudland canyon s.p. then across to i-75 just above calhoun, ga. we saw more georgia state patrol going the opposite way in a hurry than we saw the previous two days. makes you wonder what in the h * l was going on behind us back in dade county. there were at least three or four that we saw ; . one young trooper even waved as i was hitting the brakes my front end diving ; . he was going like the clappers of he. well you know. all i can say is i hope wes mccann is ok. and if he is jail, well then free wes mccann. he s got my only copy of my ride log. ; we gave them the slip somehow. it s not wes fault the committee continued on page 12.
22 receipts of the crime can be used to promote further crime. for example, a drug dealer can use the money that he is paid for a drug sale to purchase new drugs for distribution whether or not the first sale was made at a profit. moreover, the gross receipts of a criminal enterprise represent the amount of unexplained cash that could lead to detection, and thus concealing any of the gross receipts can impede detection and prosecution of the crime. a drug dealer who launders the proceeds of a loss-leading sale by funneling them through a legitimate business conceals his drug trafficking just as effectively as a dealer who launders the proceeds of a profitable deal. in either case, the drug-dealing business generates cash that is not associated with any legitimate business and could give rise to suspicions, and the laundering transaction conceals that cash and helps conceal the crime. construing "proceeds" to mean "gross receipts" thus advances the policies underlying the money laundering statute, which seeks to prevent criminals from using the fruits of their crimes to conceal or to further their illegal activities. see united states v. iacaboni, 363 f.3d 1, 5-6 1st cir. ; , cert. denied, 543 u.s. 978 2004 ; . 2. in contrast, the "profits" definition of "proceeds" would constrict the money laundering statute in significant ways that congress could not have intended. as both the district court and the court of appeals recognized, the "profits" definition would categorically preclude money laundering prosecutions based on the use of receipts of underlying crime to pay the expenses incurred in committing that crime. see pet. app. 12a, 49a, 77a-78a. that limitation follows from the "profits" definition because funds used to pay the expenses of a crime are, by definition, not the net income or profits of that.
